Terms & Conditions
Welcome to Blue Skip Bin Pty Ltd. By using our services, you agree to our terms of use, including our privacy policy. Blue Skip Bin Pty Ltd ABN 48 605 252 668 reserves the right to amend these Terms of Use at its sole discretion and without notice. If you have any questions or would like further information, please contact us via email at info@blueskipbin.com.au.
All quotes, applications and Orders for bins are subject to these Terms and Conditions and the Refund & Cancellation Policy. This document sets out the terms which you may use and in which w provide the Goods and Services. Please carefully read all terms and conditions.
1. By accepting a quote and booking a bin or any other services from Blue Skip Bin Pty Ltd, you acknowledge and agree to these terms and conditions.
2. These terms and conditions form part of a legally binding agreement between Blue Skip Bin Pty Ltd and you, the customer, who has accepted our quote.
3. All contracts made by Blue Skip Bin Pty Ltd shall be deemed to incorporate these terms and conditions, no variations or addition to them shall form part of any contract unless specifically accepted by us in writing.
4. If any portion of these terms is deemed to be invalid, illegal, or unenforceable the remaining provisions shall remain in full force and effect.
5. Payment must be made in full on or before bin delivery or other services rendered.
6. Weight allowance and excess tipping fees apply unless stated otherwise. You agree to pay any additional charges incurred for excess weight limit or loading of incorrect waste for the type of bin ordered.
7. The standard rental period is 7 days. Additional hire fees apply on a weekly basis as per the Blue Skip Bin Pty Ltd price list unless agreed otherwise in writing. Bins will be picked up after 7 days of delivery unless agreed otherwise.
8. While we will always strive to meet your required delivery times and dates, we cannot guarantee to meet them, and accordingly we will not be liable for any cost and/or losses incurred by you for any delay in the provision of good or services to your site address
9. Skip bins must not be filled above the rim. All waste must fully fit inside the bin. Bins that have been overloaded will not be picked up and additional rental and handling charges will be incurred. You acknowledge that you will be responsible for any excess waste or spillage from the skip bin. Blue Skip Bin Pty Ltd drivers reserve the right to refuse any load they deem to be unsafe or overloaded/overweight in line with legislation, guidelines, and company policy.
10. You agree to be responsible for any fines or penalties incurred to R.T.A. or law enforcement should the bin be overloaded.
11. Green waste-only, clean fill-only and masonry-only bins must not be contaminated with other waste types. This includes contaminating green waste with soil or masonry bins with gyprock, plasterboard, under-slab plastic or any other form of waste. In case of contamination, the bin price and conditions will default to a mixed waste bin with the respective weight limit restrictions in place according to bin size. Any excess weight will be charged at the standard excess weight rate as per the current price list.
12. You agree not to move the bin after it has been placed by us for delivery. Any costs associated with the recovery of a bin after it has been moved from its original placement location are borne by you.
13. You will be responsible for the provision of free, sufficient, safe access and to suitable ground conditions as well as safe access height and surrounding area at the site. Charges may incur for restricted access if bins cannot be picked up or delivered as agreed, including waiting time and futile deliveries/pick-ups.
14. Skip bins are placed and removed on/off private property by Blue Skip Bin Pty Ltd entirely at the risk of the hirer and it is your responsibility to ensure you take all reasonable steps to mitigate any damage (for instance by placing timber slats on the ground to place the bin). Except where we are negligent, Blue Skip Bin Pty Ltd will not take responsibility for any damage to any surface, plants, walls or property caused by the company’s vehicles or equipment whilst on the hirer’s premises. You will not be entitled to withhold payment for any such damage.
15. We reserve the right to refuse delivery to any location where the site is deemed unacceptable from a safety perspective. You must bring to the attention of the driver any hazards on the property, utility cables, manholes, overhanging trees etc. You agree that you are responsible for any Work Health Safety Laws relating to the site. A call-out fee applies where delivery is unsuccessful. Futile delivery charges may apply.
16. You accept responsibility to ensure that you have obtained any permission required from any relevant person, entity, or authority (including strata / body corporate or councils) to place a bin on the site requested.
17. Prohibited materials are not permitted and include food or animal waste, wet waste, fibro, asbestos, tyres, batteries, liquids, contaminated soil, paints, gas bottles, fire extinguishers, asphalt and bitumen, aerosols, chemicals including household cleaning and personal care items, resin, E-waste including solar panels, hot ash, or any other hazardous, toxic, corrosive, or explosive material.
18. Asbestos and asbestos-containing products are only permitted to be disposed of in our designated asbestos bins with prior notification. They are not permitted in any other bins. Tipping fee charges apply in addition to bin hire and delivery charges.
19. You must not light fires in the skip bin.
20. The bin will be used by you for the purpose of depositing waste into and may not be used for any other purpose unless agreed to with Blue Skip Bin Pty Ltd.
21. You agree to take reasonable care of all skip bins and equipment and agree to indemnify Blue Skip Bin Pty Ltd for any damage done (other than due wear and tear) to their bins and agree to pay additional fees for any non-standard cleaning that may be required.
22. You agree and acknowledge that once the skip bin is being loaded onto the vehicle you will have no claim to the waste from that time onwards.
23. Free order cancellations must be made at least 24 hours prior to delivery. Otherwise, cancellation charges apply.
24. Whilst all care is taken when delivering and picking up skip bins by our employees, the hirer of the bin will not hold Blue Skip Bin Pty Ltd responsible for any damage caused by the placement of the skip bin. If an incident has occurred, please ensure you notify us on (02) 4326 8165 as soon as possible and, if possible, the driver at the time of the incident to ensure all corrective action is taken.
Additional Clauses
Service
1. Blue Skip Bin Pty Ltd will supply and deliver the specified Skip Bin to the Delivery Address on the Delivery Date and collect the delivered Skip Bin on the Pick-up Date specified in the booking.
Fees & Charges
1. Maximum hire duration is 14 days.
2. The Customer will pay the specified amount to Blue Skip Bin Pty Ltd in consideration of the agreed services to be provided by Blue Skip Bin Pty Ltd to the Customer and pursuant to the terms of this Agreement.
3. All fees and charges are inclusive of GST unless otherwise specified.
4. The Customer acknowledges that the Services may be suspended by Blue Skip Bin Pty Ltd if payment is not received or the Customer is otherwise in arrears of its payment obligations under this agreement.
5. The Customer acknowledges that they may be required to pay Additional Charges should they incur such chargers in accordance with clause 3.
Additional Charges
1. In addition to the Charges for the Services, additional charges may be applied and charged to the Customer at Dump It Bin’s reasonable discretion. These may include:
• Excess loading fees
• Expenses and costs incurred by Blue Skip Bin Pty Ltd such as costs to deal with Prohibited Materials and non-accepted waste such as artificial grass, carpet, fibro, asbestos or insulation materials. All Restricted/Hazardous pricing can be sourced once the relevant reports are sent via email to info@blueskipbin.com.au.
• Pricing must be adhered to with approval sent in writing prior to the waste being transported and disposed of.
Payment
1. The Customer shall pay the Specified Fees due under this Agreement to Blue Skip Bin Pty Ltd at the time of submitting and processing the order.
2. The Customer shall pay any Additional Charges incurred to Blue Skip Bin Pty Ltd after being invoiced of such Additional Charges.
3. Payment online shall be made by the Customer by Cash, Credit Card or Direct Bank Transfer.
4. Approved commercial credit account applicants are strictly thirty (14) days from the day invoice issue, trade will be restricted if payments are not made within the Terms and Conditions outlined in the commercial credit account. Non-Payments will be pursued under the Building and Construction Industry Security of Payments Act 1999 NSW.
Cancellation or Variation of Order
1. Blue Skip Bin Pty Ltd may terminate the Agreement by giving notice to the Customer if:
• The Customer is in breach of this Agreement;
• The Customer fails to make the required payments or the customer is otherwise in arrears of its payment obligations in accordance with this Agreement;
• The Skip Bin(s) are being used for a purpose other than what is outlined in this Agreement;
• Blue Skip Bin Pty Ltd has received notice that the Skip Bin(s) have been placed on a Site without the Customer having first obtained appropriate permission.
Ownership
1. The Customer acknowledges that all Skip Bin(s) and Equipment remains the property of Blue Skip Bin Pty Ltd at all times.
Delays
1. If, through no fault of Blue Skip Bin Pty Ltd, the pickup is delayed on Site and the driver is required to wait more than 15 minutes, the truck may be directed offsite and a call-out fee of $100 charged.
Orders & Delivery
1. All orders placed by phone before 10 am on a business day can be delivered on the same day, pending confirmation of availability.
2. For any specific order requirements such as a faster delivery time, you should contact us directly by phone on 02 8722 9909.
3. For early morning services, we recommend placing a booking by 3 pm one day prior.
Change Of Address
1. The Customer may change the Delivery Address of where the Services are to be performed and Skip Bin(s) delivered, as long as the new address remains within an area where Blue Skip Bin Pty Ltd operates. Notice of this new address must be provided no later than 2 business days prior to the Delivery Date.
Customer Obligations
The Customer acknowledges and agrees:
1. To not compact waste into the Skip Bin(s) and/or excessively overfill the Skip Bin(s);
2. To use the Skip Bin(s) as directed by Blue Skip Bin Pty Ltd and as outlined by this Agreement, at the agreed location;
3. To not remove the Skip Bin(s) from the agreed location;
4. To not use the Skip Bin(s) for any illegal purpose which contravenes this Agreement or any law;
5. To use the supplied Skip Bin(s) in a reasonable and sensible manner;
6. To bear responsibility and liability for any loss, damage or destruction of the Skip Bin(s) whilst the Skip Bin(s) is under the custody and control of the Customer;
7. To make the Skip Bin(s) ready for collection by Blue Skip Bin Pty Ltd at the agreed Pickup Date;
8. To not deface or damage the Skip Bin(s). Damaged bins will be invoiced directly to the customer; it is then the customer’s responsibility to pursue any liable contractors;
9. To only use the Skip Bin(s) for disposing accepted materials and waste;
10. To obtain all necessary approvals, required consents and permits, at its own expense, relating to the Services and to the disposal of Waste by Blue Skip Bin Pty Ltd;
11. That they will indemnify Blue Skip Bin Pty Ltd in the event of any claims, suits and demands for damages caused directly or indirectly to any person or property (including the Customer), by the operation of Equipment;
12. To comply with all reasonable instructions given by Blue Skip Bin Pty Ltd.
Weight
1. A limitation of weight will apply on certain bin sizes to ensure road safety standards are met and that all Blue Skip Bin Pty Ltd vehicles stay within the maximum allowable capacity enforced by the Roads and Maritime Services of New South Wales.
2. Blue Skip Bin Pty Ltd may in its discretion refuse to collect the Skip Bin(s) if they are overweight.
3. Bins that are loaded above the rim are deemed overloaded. It is at the driver’s discretion whether the bin can safely be transported.
Site
1. Blue Skip Bin Pty Ltd will rely on the information and instructions provided by the Customer in respect to the Site and access to the site.
2. The Customer must ensure that the site has safe and unobstructed access for Blue Skip Bin Pty Ltd to safely deliver and pick-up the Skip Bin(s).
3. The Customer is solely responsible for obtaining permission for the relevant person/s, if the Skip Bin(s) is to be placed on a communal or public site or other location which in the circumstances requires the permission of a third party.
Waste/Environmental Management Reports
1. Waste/Environmental Management Reports will be issued within fourteen (14) days of the reportable period.
Liability & Indemnity
1. The Customer shall be responsible for and shall indemnify Blue Skip Bin Pty Ltd against liability for all loss, damage or injury to Blue Skip Bin Pty Ltd arising or caused by the Customer’s breach of these terms or the Customer’s use, custody or control of the Skip Bin(s).
Privacy Act
1. Blue Skip Bin Pty Ltd and its related entities are committed to the protection of personal information in accordance with Australians Privacy Principles set out in the Privacy Act 1988 (Cth).
2. Use of the information posted on this website for commercial purposes is prohibited without the prior written consent of Blue Skip Bin Pty Ltd.
3. Any copy or reproduction of this or any part of it is prohibited except with the prior written consent of Blue Skip Bin Pty Ltd.
